Moscow, Aug 17 (Reuters) - Russian airline Pobeda has pulled out of contracts for 20 Boeing 737 MAX planes, the low cost unit of national flag carrier Aeroflot (AFLT.MM) said on Tuesday.

Russia has not authorised flights by Boeing (BA.N) 737 MAX planes since a ban that followed two crashes involving the aircraft that killed 346 people in 2018-19.

"We have given up on firm contracts for 20 Boeings 737 MAX, without any penalties," Pobeda said in a statement sent to Reuters.

Leasing companies GECAS and SMBC had been due to deliver five and 15 of the planes to Pobeda, respectively.

The airline said one of the reasons for the decision not to acquire the aircraft was the lack of state approval to use them.

Pobeda operates 44 Boeing 737-800 aircraft and expects to receive 20 planes a year from its parent company Aeroflot in 2022–2023.

A Administração Federal de Aviação dos Estados Unidos (FAA) emitiu uma Diretiva de Aeronavegabilidade (DA), na última terça-feira (17), alertando sobre uma ‘condição potencialmente insegura’ envolvendo o Boeing 737-800 e o 737-900ER.

O alerta foi dado após rachaduras foram encontradas nos encaixes que fornecem a fiação entre o radome, onde está localizado o radar meteorológico, e a fuselagem. Em julho, a israelense El Al identificou duas aeronaves de sua frota com este problema e reportou o caso para autoridades de aviação locais e também para a fabricante.

A FAA determinou que as companhias aéreas norte-americanas realizem inspeções estruturais para verificar se há alguma rachadura e/ou mudança nos sistemas de conectividade a bordo. Há o risco da fissura solte o radome e a antena durante o voo, causando danos ainda maiores à fuselagem e também para a cauda.

O Boeing 737 é operado nos Estados Unidos por cinco companhias aéreas, incluindo a Southwest Airlines, que detém a maior frota do modelo no mundo.

Two-and-a-half years after the deadly Ethiopian Airlines 737 MAX crash, with the final investigation report into the accident still pending, the airline’s management has reached a settlement with Boeing and said it expects to resume flying the jet again by January.

In an interview with Bloomberg News on Thursday, Ethiopian Airlines CEO Tewolde GebreMariam said he was convinced “beyond reasonable doubt” that the MAX as upgraded by Boeing after the two fatal crashes is now safe.

“We are happy on the settlement,” Tewolde said.

“I can confirm that we are committed to the Boeing 737 MAX,” he said. “My estimate is by the end of the calendar year or beginning of next year, January, we will be flying the airplane.”

The Ethiopian government’s aviation authority has not yet lifted the grounding of the MAX imposed a day after Flight ET 302 crashed in March 2019 and took 157 lives. Yet clearly the government-owned airline fully expects the regulators to approve the jet’s return to service by the end of the year.

The financial terms of the settlement were not disclosed. The Seattle Times reported exclusively in January that Boeing had then offered an amount on the order of $500 million to $600 million, a large portion of which was not cash but concessions, including discounts on future airplane sales and waivers on maintenance costs.

A Chicago law firm advising the airline wrote a letter to CEO Tewolde then urging him to reject a settlement and instead to sue the manufacturer for punitive damages in the U.S., hoping to win “not less than $1.8 billion in cash.” That advice wasn’t taken.

The settlement comes as Ethiopia is torn by a bloody civil war in the northern region of Tigray that has frayed relations with the U.S. and undermined its economy.

Meanwhile, the state-owned airline has struggled for 18 months with the extreme downturn in air travel due to the global COVID-19 pandemic.

 

Partnering with Boeing

Parallel to the settlement over the MAX, Ethiopian Airlines this week made public a related agreement: Boeing will partner with Ethiopian to make the airline’s base in Addis Ababa “Africa’s aviation hub” and to set up a manufacturing facility there to make airplane parts.

Ethiopia already supplies some small-scale wire harnesses for Boeing aircraft. Boeing has committed to expand local capabilities both in aerospace manufacturing and in airplane repair and overhaul. 

This aviation work will complement the planned construction of a new $5 billion airport south of the capital.

In addition, the partnership will promote the training of pilots and aircraft technicians at the airline’s Aviation Academy in Addis Ababa, and STEM education in Ethiopian schools.

Bob Clifford, a Chicago-based lawyer representing families of the crash victims, isn’t surprised by the news of a settlement.

“Life goes on,” Clifford said. “Boeing very much wants to put this chapter behind it.”

Of course, for the families of those killed, there’s little inclination to “move on.”

A Justiça do Estado de Delaware, nos Estados Unidos, decidiu que acionistas da Boeing podem processar a empresa, por falta de monitoramento da segurança e da aeronavegabilidade do 737 MAX. Os dois acidentes envolvendo aeronaves da Lion Air e da Ethiopian Airlines, que mataram 346 pessoas, foram os fatores decisivos para o parecer final.

Segundo o juiz Morgan Zurn, em parecer publicado na terça-feira (7), "embora possa parecer insensível diante de suas perdas, a lei corporativa reconhece outro conjunto de vítimas: a Boeing como uma empresa, e seus acionistas”, mas que “as principais (...) são, é claro, os falecidos, suas famílias e seus entes queridos”.

O magistrado acrescentou ainda que, mesmo após a queda do voo JT610 da Lion Air em 29 de outubro de 2018, que matou 189 passageiros e tripulantes minutos após a decolagem de Jacarta (CGK), o foco das reuniões do conselho da fabricante em dezembro, em relação ao 737 MAX e o acidente, foi para restaurar a lucratividade e a eficiência, ignorando a gravidade da situação.

Em resposta, a Boeing se mostrou ‘decepcionada’ com a decisão e afirmou que, em 2020, os custos não litigiosos sobre este caso incorreram em US$ 20 bilhões (R$ 104,4 bilhões) e os litigiosos em US$ 2,5 bilhões (R$ 13 bilhões).
